• Improper or incorrect fitment
• Damage to the item(s), the Buyer’s vehicle, property, or any other property
• Personal injury or death
• Any malfunction, failure, or defect in the item(s)
• Installation, removal, use, misuse, or modification of the item(s)
• Any consequential, incidental, special, punitive, or indirect damages
This release extends to any claims based on negligence, strict liability, breach of warranty, product liability, or any other legal theory.
4. ASSUMPTION OF RISK
The Buyer expressly assumes all risks associated with the purchase, possession, installation, and use of the item(s), including but not limited to risks of property damage, personal injury, or death.
5. NO REFUNDS, RETURNS, OR EXCHANGES
All sales are final. No refunds, returns, exchanges, or credits will be issued for any reason, including but not limited to incorrect ordering, improper fitment, buyer remorse, or dissatisfaction with performance.
6. INDEMNIFICATION
The Buyer agrees to defend, indemnify, and hold the Seller harmless from and against any and all third-party claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of the Buyer’s purchase, possession, installation, use, or resale of the item(s).
7. GOVERNING LAW AND SEVERABILITY
This Disclaimer shall be governed by the laws of the jurisdiction in which the Seller is located. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
